DOMESTIC ADOPTION

Adoption in Italy: domestic and intercountry routes explained

Most English-language guides blur three different situations: adopting a child within Italy, adopting a child from another country while living in Italy, and adopting an Italian child into a household abroad. They are not the same process. This guide focuses on prospective adoptive parents based in Italy, giving you an accurate starting point before you spend money or complete forms.

Section 01

Start with the legal route, not an agency

In a domestic adoption, a child within the Italian child-protection and court system may be declared adoptable. The juvenile court identifies a family able to meet that child's needs. In an intercountry adoption, people resident in Italy follow Italian procedures and then the procedures of the child's country of origin, supported by an organisation authorised by the Commissione per le Adozioni Internazionali (CAI). The child's welfare is central in either case: an application is not a request to select a particular child.

What to check

  • Domestic: examine the Italian Ministry of Justice's guidance and your competent juvenile court.
  • Intercountry: examine the CAI's official pathway and register of authorised organisations.
  • Adopting an Italian child while resident abroad is a separate jurisdictional question and is not covered by this guide.

Section 02

Who can apply? The answer differs by route

Ordinary domestic adoption under Law 184/1983 generally concerns married couples who satisfy requirements about relationship stability, suitability and age differences. The law allows the three-year relationship requirement to be established using a qualifying period of premarital cohabitation plus marriage, as assessed by the court. In 2025, Constitutional Court judgment 33 opened eligibility assessment for intercountry adoption to single people resident in Italy. It did not automatically alter ordinary domestic eligibility or require every foreign country to accept single applicants.

What to check

  • Do not confuse the normal 18-to-45-year age difference with a strict maximum age of 45 for an applicant.
  • Check exceptions in legislation rather than relying on a simple online calculator.
  • An international application also depends on the origin country's current eligibility rules.

Section 03

What are the actual steps?

Start with your court's requirements and the relevant preparatory services. In Piemonte, for example, the Region runs preparation sessions and the Turin Juvenile Court publishes separate forms for couples and single intercountry applicants. Domestic applicants make a declaration of availability that is normally valid for three years, rather than obtaining a guaranteed place in a queue. Intercountry applicants move from Italian court assessment to a suitability decision, then to an authorised organisation and foreign-country procedures.

What to check

  • Read the actual application form and accompanying instructions for your district.
  • Keep a record of submission and notification dates.
  • Ask which requirements are legal rules and which reflect local practice.

Section 04

Costs and time: avoid misleading comparisons

Domestic applications do not carry the same overseas-organisation and travel costs as intercountry adoption. Time spent preparing a domestic application is not the same as the unpredictable time before any potential matching. In its published 2025 report, CAI recorded 527 intercountry procedures involving authorisation for 664 children and an average overall duration of about 50 months. That is a historical mean for completed intercountry cases, not a promise, forecast or statistic about domestic adoption.

What to check

  • Separate court and social-services stages from matching.
  • Get a written intercountry fee schedule with Italian, overseas and travel items separated.
  • Do not use country totals or averages to estimate your personal probability of adopting.

Section 05

A practical way to use this site

Read the route that applies to you, then open the original institution page alongside it. The court or authorised organisation remains responsible for current documents and case-specific instructions. Use the guides here to formulate better questions and avoid mixing legally distinct procedures; do not rely on one article as a substitute for a formal decision or professional advice.

PRACTICAL ANSWERS

Frequently asked questions

Can I adopt an Italian child if I live outside Italy?

This raises different nationality, residence and intercountry rules. It should not be conflated with an Italy-resident household adopting within Italy; obtain case-specific official guidance.

Is a three-year Italian adoption declaration a waiting-time guarantee?

No. Three years is normally the validity of a domestic declaration of availability, which can be renewed; matching is a separate process.

Can I pursue domestic and international pathways at once?

The pathways can interact. In particular, CAI says an intercountry organisation must be informed promptly if an applicant family begins domestic pre-adoptive placement, because the family's circumstances and suitability record change.
