DOMESTIC ADOPTION
Domestic vs intercountry adoption in Italy: what changes?
The words 'adoption in Italy' cover two different legal journeys for Italy-resident applicants. Domestic adoption and intercountry adoption share the focus on a child's welfare, but they differ in authorities, documents, costs and key deadlines. A practical comparison is more useful than treating them as two versions of the same application.
Section 01
Different legal routes and decision-makers
Domestic adoption concerns a child within the Italian judicial child-protection system and decisions by the competent juvenile court. Intercountry adoption generally starts with Italian court assessment and then involves an authorised organisation, foreign authorities and the CAI framework. The latter is not a direct application to a foreign registry and the former is not a request to choose a child from a waiting list.
What to check
- Identify which route applies to the child's country of habitual residence.
- Use the court's local instructions for the Italian application.
- For intercountry procedures check CAI's authorised organisation register.
Section 02
The two deadlines everyone confuses
Italy's Ministry of Justice describes the domestic declaration of availability as valid for three years, with renewal possible. CAI's intercountry FAQs describe a different one-year period: from notification of an intercountry suitability decree to appointing an authorised organisation. Neither is a guaranteed wait until matching, and neither proves that the next stage will complete on a particular date.
What to check
- Make a separate diary entry for each legal deadline.
- Distinguish the Italian suitability decision from the overseas matching phase.
- Ask competent officials what happens if your circumstances change.
Section 03
Costs and practical obligations differ
Domestic court applications do not require the formal overseas-organisation mandate that is essential for intercountry adoption. International costs may include the organisation's services, foreign-country procedure, documents, translation, travel and post-adoption work. CAI publishes guidance requiring authorised organisations to make cost information available. There is no defensible universal fee or time estimate that applies across all countries and family circumstances.
What to check
- Compare current written and itemised quotes.
- Keep reimbursement eligibility separate from costs due upfront.
- Prepare for travel and post-adoption reporting in the intercountry route.
Section 04
Can both routes be pursued? Why you must disclose changes
The routes are not independent reservations. CAI FAQ D8 explains that where a family has appointed an intercountry organisation and a domestic pre-adoptive placement begins, the organisation must be informed immediately. The new family circumstances affect the previous suitability assessment and may require updated reports. Plan for one child joining the household before assuming the other procedure can continue unchanged.
What to check
- Ask the Italian court about the scope of any parallel applications.
- Notify your authorised organisation of a domestic placement or other major family changes.
- Avoid using historical adoption totals to infer the likelihood of two placements.
PRACTICAL ANSWERS
Frequently asked questions
Is domestic adoption always quicker?
There is no universal answer: the legal stages and matching processes differ, and an individual family's future cannot be forecast from headline averages.
Does three-year validity mean matching must happen within three years?
No. It is the period for which the domestic declaration remains valid unless renewed, not a placement promise.
Can a family complete an international adoption automatically after a domestic placement?
CAI requires notification and reassessment of circumstances; it should not be assumed that the prior intercountry file can continue unchanged.
